Do I need a permit for a driveway, retaining wall or levelling?

What needs no permit

• A retaining wall up to 2 metres that does not substantially change the ground.
• A boundary wall up to 1.8 metres, not on the public road.
• In Loulé: a path or driveway to a parking space on your own land, in permeable material (gravel, open paving), as long as it does not affect the public road.
• In Loulé: mesh fencing up to 2 metres without a continuous concrete base, set back from municipal paths and roads.

What does need a permit or notification

• Substantially raising or lowering the ground. Loulé only allows it with good justification and no harm to neighbours, and it must not create retaining walls over 2 metres.
• Walls on the public space higher than 1.2 metres of masonry (with open work above up to 2 metres).
• Anything near a protected monument.

On rural land, RAN and REN may also apply, with a separate notification to the CCDR. If in doubt, ask the câmara for information first: that is the safe route.
